1. Scope and operator
These Terms of Use govern your use of germangrad.com and all GermanGrad courses, lessons, mock tests, guides and automated written feedback (the “Service”).
By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Different terms of yours do not apply unless we agree to them in writing.
2. Payments through Polar (Merchant of Record)
Our order process is conducted by our online reseller Polar Software, Inc. (USA). Polar is the Merchant of Record for all paid orders and handles checkout, payment, invoicing, sales tax/VAT, and billing-related customer service and returns.
When you buy a paid plan, you enter into the purchase contract with Polar, and Polar’s own Buyer Terms apply to that purchase. These Terms govern your use of the Service itself. We never see or store your full card details.
3. Accounts
You must be at least 16 years old to create an account. If you are under 18, you need a parent or guardian’s consent to buy a paid plan.
You must give accurate details and keep your login private. An account is for one person; sharing it or reselling access is not allowed. You are responsible for activity under your account, and you should tell us at info@germangrad.com if you think it has been misused.
4. Plans and what they include
GermanGrad offers a free plan and paid subscriptions. The current features and prices are always those shown on our pricing page at the time you order.
| Plan | Price | Billing |
|---|---|---|
| Free | $0 | Free, no payment details needed |
| Pro | $4.99 per month | Monthly, renews automatically |
| Pro Annual | $48 per year | Yearly, renews automatically |
Prices include VAT where applicable; Polar calculates the final amount for your country at checkout.
Launch and promotional offers (such as free access until a stated date) apply only as described in the offer. When a free period ends, you will not be charged unless you choose a paid plan and enter payment details at checkout.
We may add, change or remove course content and features to improve the Service. If a change substantially reduces what a paid plan includes, we will tell you in advance and you may cancel.
5. Payment, renewal and cancellation
Paid plans are charged in advance by Polar using the payment method you provide. Subscriptions renew automatically at the end of each billing period (monthly or yearly) until you cancel.
You can cancel at any time on our cancellation page, linked from the foot of every page, in Polar’s customer portal, or by writing to info@germangrad.com. Cancellation takes effect at the end of the current billing period, and you keep access until then.
If a Pro Annual subscription renews and you are a consumer, you may cancel the renewed subscription at any time with one month’s notice. You then receive a pro-rata refund for the full months remaining.
We will tell you at least 30 days in advance of any price increase for your plan. The new price applies from your next billing period, and you may cancel before then. If a payment fails, we may pause paid features until it succeeds.
6. Right of withdrawal and refunds
If you are a consumer in the EU, you have a 14-day right to withdraw from a paid subscription without giving a reason, starting on the day of purchase.
To withdraw, send a clear statement (for example an e-mail) to info@germangrad.com within those 14 days. You receive a full refund of that payment, paid back through Polar to your original payment method within 14 days of our receiving your withdrawal.
After 14 days, payments are not refundable except where required by law or set out in Section 5. Statutory consumer rights are never limited by these Terms.
7. Written feedback on your German
Paid plans include a monthly allowance of written feedback, as shown on the pricing page. You write a text in the course and the Service returns comments on it sentence by sentence.
This feedback is generated automatically by software, not written by a teacher, and it is labelled as such in the Service. It is produced immediately and can be wrong, so treat it as practice, not as a marked exam. Unused allowance does not carry over to the next month.
GermanGrad is a self-study product. We do not provide one-to-one tutoring, coaching, consulting or scheduled live classes, and nothing in these Terms entitles you to them.
8. Acceptable use and intellectual property
All lessons, videos, exercises, mock tests, guides, PDFs and other materials on GermanGrad belong to us or our licensors. We give you a personal, non-transferable licence to use them for your own learning while your account is active.
You may not:
- copy, download, resell, publish or share course materials, except as the Service allows
- share your login or give others access to paid content
- scrape, copy or automatically extract content from the Service
- try to break, overload or get around the security of the Service
- post or send unlawful, abusive or harassing content
Texts you submit for correction remain yours. You allow us to store and comment on them to provide the Service. We will not publish them without your permission.
9. Exams, results and visa information
GermanGrad is an independent course. We are not affiliated with, endorsed by or acting for telc gGmbH or the Goethe-Institut. Our materials follow their published exam formats. You register for and sit any official exam yourself with a recognised exam centre, and pay its fees separately.
We do not guarantee that you will pass an exam or reach a particular level. Results depend on your own study and the exam itself.
Our visa, residence, PR and Ausbildung guides explain rules in general terms and are dated when reviewed. They are not legal advice. For a binding answer, contact the responsible Ausländerbehörde, German mission or an immigration lawyer.
10. Availability and liability
We aim to keep the Service available at all times but cannot guarantee uninterrupted access. Maintenance, updates or technical problems may cause short outages.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
For slight negligence, we are liable only for breach of an essential contractual obligation (one that makes proper performance possible and on which you may normally rely). In that case our liability is limited to the typical, foreseeable damage. Any other liability for slight negligence is excluded.
11. Termination, changes and final provisions
You can delete your account at any time by writing to info@germangrad.com. We may suspend or close an account that seriously or repeatedly breaks these Terms. If we close a paid account without such a reason, we refund unused prepaid fees.
We may update these Terms for good reason, for example new features or legal changes. We will notify you by e-mail at least 30 days before changes take effect for existing users. If you object, you may cancel before the changes apply.
These Terms are governed by German law. If you are a consumer living in another country, the mandatory consumer protection laws of that country still apply.
We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
If any provision of these Terms is invalid, the rest remain in effect.
